Terms of Use

The agreement between you and Andrii Myhal, the developer of AI Studio, for using the app. This is also the app’s end user licence agreement (EULA).

1. The agreement

By downloading or using AI Studio you agree to these terms and to our Privacy Policy. If you do not agree, do not use the app. “We” and “us” mean Andrii Myhal, the developer of AI Studio.

You must be at least 13 years old to use the app. If you are under the age of majority where you live, you may use it only with the permission of a parent or guardian, who accepts these terms for you.

2. The service

AI Studio makes videos, images and music from your text and photos using AI models run by third-party providers. Results are generated automatically: they can differ from what you expected, can be inaccurate, and two people can receive similar results. Models, formats, prices in credits and features can change, and a model can become unavailable, including because a provider changes or stops its service.

3. Subscriptions

• Creating requires an active subscription. The plans, their prices and the credits each includes are shown in the app before you buy.
• Payment is charged to your Apple ID when you confirm the purchase.
• A subscription renews automatically at the same price and for the same period unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID is charged for the renewal within 24 hours before the current period ends.
• You can manage or cancel a subscription in Settings → your name → Subscriptions. Deleting the app does not cancel it. After cancelling, the plan stays active until the end of the period you paid for.
• If a price changes, Apple tells you in advance and, where the law or App Store rules require it, asks for your consent.
• Refunds are handled by Apple under its policies, at reportaproblem.apple.com. We cannot issue refunds for App Store purchases ourselves.

4. Credits

• Each generation costs credits. The cost is shown before you tap Generate and depends on the level, length, quality and options you choose.
• A plan adds its credits at the start of each week (weekly plan) or each month (monthly and 3-month plans). Plan credits that are not used by the next top-up do not carry over.
• Credit packs are available to subscribers. Pack credits do not expire, are spent after your plan’s credits, and can be used only while a subscription is active.
• If a generation fails or a provider refuses it, its credits are returned automatically.
• Credits are a licence to use the service, not money or property. They have no cash value, cannot be transferred or exchanged, and are not refundable except where the law requires it. Deleting your data also deletes your credit balance.

5. Your content

What you give us. You keep all rights to the prompts, photos and videos you submit. You give us a limited licence to store them, process them and send them to AI providers only to produce your results and run the service, for the periods described in the Privacy Policy. You confirm you have the rights and permissions needed to submit them — including the consent of any person who appears in a photo or video you upload.

What you make. As between you and us, the results you generate are yours to use for any lawful purpose, including commercially. We claim no ownership of them. Your use of results is also subject to the law and to the terms of the model’s provider, and in some countries AI-generated material may not be protected by copyright. You are responsible for how you use and share your results.

We do not use your content to train AI models.

6. What you may not create

You may not use AI Studio to create, upload or share:

• any sexual or sexualised content involving minors — we report it to the authorities;
• sexual or intimate imagery of a real person, or any content depicting a real person without their consent;
• content meant to deceive — impersonating someone, fake evidence, fraud, or misinformation presented as real;
• content that harasses, threatens, bullies or promotes hatred or violence against people or groups;
• content that promotes self-harm, terrorism or illegal activity;
• content that infringes someone else’s copyright, trademark, privacy or other rights;
• anything else illegal where you live or where you share it.

You also may not reverse-engineer, scrape or automate the app, circumvent credit or usage limits, resell access, or interfere with the service. We and the AI providers may filter requests, refuse to generate, remove content, and suspend or end access for anyone who breaks these rules.

7. Ending the agreement

You can stop using the app at any time, and delete your data from Profile → Delete my data. We may suspend or end your access if you break these terms or if we have to stop the service; if we stop the service altogether, we will give reasonable notice where we can.

8. No warranty

The app and its results are provided “as is” and “as available”. To the extent the law allows, we make no promises that the service will be uninterrupted or error-free, that results will meet your needs, or that they are accurate or suitable for any purpose. Nothing the app generates is professional advice.

9. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential losses, lost profits or lost data, and our total liability to you is limited to the amount you paid for the app in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or any rights you have under the consumer laws of the country where you live.

10. Apple

• These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
• Your licence to use the app is non-transferable and limited to Apple-branded devices that you own or control, as permitted by the App Store’s Usage Rules.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
• We, not Apple, are responsible for any claims about the app, including product liability, failure to meet legal or regulatory requirements, consumer protection and privacy claims, and claims that the app infringes someone’s intellectual property.
• You confirm you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

11. Changes

We may update these terms. We will change the date above and, if a change is significant, tell you in the app before it applies. Continuing to use the app after that means you accept the new terms.
